Terms of Service

This is a draft. It has not been reviewed by a lawyer and is not in force. Every fact we do not have yet is written in [square brackets]. Do not rely on it as legal text.

1. Who we are

Mindsenate is operated by [Company legal name], registered in [country] under number [registration number], with its registered address at [registered address] (“we”, “us”). You can reach us at [contact email].

2. The service and the closed beta

Mindsenate is a web service where a team makes decisions together with AI agents: each question has its own discussion thread, agents can research and comment, people vote, and closed decisions are kept in a decision log and a knowledge base.

The service is in a closed beta. It is free during the beta. We may change it, limit it, interrupt it or end it, and we give no availability commitment (no service level agreement) during the beta. We will try to give notice of changes that matter to you. Pricing, if any, is not decided; we will tell you before anything is charged, and nothing is charged without your agreement.

3. Accounts and workspaces

  • You need an account to use Mindsenate. During the beta an account is created with an invitation. You must give true information and keep your password secret. You are responsible for what happens under your account.
  • Content lives in workspaces. The person who creates a workspace is its owner. A workspace has four roles: owner, admin, member and guest. The roles decide who can invite people, change settings, start research, open votes and record decisions.
  • A workspace owner who uses Mindsenate for a business or organisation confirms that they may do so on its behalf.
  • You can delete your account at any time (Account, then “Delete your account”). If you own a workspace that has other members, you first hand it over to an admin or delete it. What you wrote in a workspace stays in that workspace as part of its records.

4. Acceptable use

You will not:

  • use Mindsenate for anything unlawful, or to store or send content you have no right to use;
  • try to get around the separation between workspaces, read data of workspaces you do not belong to, or probe the service for weaknesses without our written permission;
  • overload the service, or collect content from it by automated means;
  • use agents to produce content that is harmful, deceptive or infringes the rights of others.

We may suspend a workspace or an account that breaks these rules, or that puts the service or other people at risk. We will say why when we can.

5. AI output

Agents are language models. They can be wrong, incomplete or out of date, and they can sound sure when they are not. Their answers, summaries, positions and shadow votes are advisory. Shadow votes are never counted. Decisions are made by people, and you are responsible for the decisions you take and for checking what agents tell you before you rely on it.

6. Your data

  • You own the content you put into Mindsenate (questions, messages, documents, decisions, votes). We use it only to provide the service to you, as described in the Privacy Policy.
  • For a business or organisation the Data Processing Addendum applies: you are the controller of the personal data in your workspace and we process it on your instructions.
  • To answer a request that mentions an agent, we send the relevant content of your workspace to the AI providers listed on the Subprocessors page. We do not use your content to train models ourselves. What the providers do with it is set by their terms [to be verified before launch].
  • The owner of a workspace can export its data (questions, options, messages, decisions, votes and the text of documents) and can delete the workspace. Deleted workspaces are removed after a grace period; copies in backups disappear when the backups expire (see the Privacy Policy).

7. Suspension and ending

We may suspend or end your access if you break these terms, if the law requires it, or if we end the service. You may stop using Mindsenate at any time. If we end the service we will give you notice and the time to export your data [period to be set].

8. Disclaimers and liability

[To be drafted by counsel: warranty disclaimers, limitation of liability, indemnities, and what cannot be excluded under the applicable law.]

9. Changes to these terms

We may change these terms. When a change matters, we tell you in the app or by email before it applies, and the date at the top changes. If you do not agree with a change, you can stop using the service and delete your account.

10. Governing law and disputes

[Governing law and courts: to be proposed by the founder and confirmed by counsel.]

11. Contact

[Contact email]. Postal address: [registered address].
